CONCERNING
REQUIREMENTS FOR THE IMPORT OF MOTOR VEHICLES IN COMPLETELY BUILT UP (CBU) CONDITION

THE MINISTER C E INDUSTRY AND TRADE,

Considering:

• a. that with a view to preventing the emergence of deeper social disparity and unrest in the period of economic crisis, it is necessary to conduct control over the import of motor vehicles in completely built uf5 (CBU condition;
• b. that for the protection of importers, owners and or users of motor vehicles imported in CBU condition, the types of motor vehicles imported need to be registered;
• c. that for this purpose it is necessary to issue a decree of the Minister of Industry and Trade.

In view of :

• 1. Law No. 5/1984 an industries (Statute Book of 1984 No. 22, Supplement to Statute Book No. 3274);
• 2. Law No. 14/1992 on road traffic and transportation (Statute Book of 1992 No. 48, Supplement to Statute Book No. 3480);
• 3. Government Regulation No. 17/1986 on the authority over the regulation, fostering and development of industries (Statute Book of 1986 No. 23, Supplement to Statute Book No. 3330);
• 4. Government Regulation No. 44/1993 on motor vehicles and drivers (Statute Book of 1993 No. 64, Supplement to Statute Book No. 3530);
• 5. Presidential Decree No. 355/M/1999 on the establishment of the Cabinet for the period of 1999 - 2004;
• 6. Presidential Decree No. 136/1999 on the status, duties, functions, organizational structures and working procedures of ministries;
• 7. The Decree of the Minister of Industry and Trade No. 444/MPP/Kep/9/1998 and No. 24/MPP/Kep/1/1999 on the organization and working procedure of the Ministry of Industry and Trade;
• 8. The Decree of the Minister of Industry and Trade No. 275/MPP/Kep/6/1999 on the automotive industry;
• 9. The Decree of the Minister of Industry and Trade No. 276/MPP/Kep/6/1999 on the registration of motor vehicle types and variants.

DECIDES:

To stipulate:

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING REQUIREMENTS FOR THE IMPORT OF MOTOR VEHICLES IN COMPLETELY BUILT UP (CBU) CONDITION.

Article 1

(1) The types of motor vehicles in CBU condition which will be imported shall first be registered with the Directorate General of Metal, Machine, Electronic and Multifarious Industries.

(2) Within the framework of registration of the types of motor vehicles as meant in paragraph (1), importing companies shall submit required documents as the following:

• a. Vehicle Identification Numbers (VIN) from originating countries of manufacturers, which at least mention originating countries; manufacturers, specifications of types and manufacturing years;
• b. type verification certificates/evidence from the Ministry of Communications for the imported types of motor vehicles already reaching the number of more than 10 (ten) units;
• c. type verification certificates/evidence from originating countries of manufacturers or import originating countries for the imported types of motor vehicles reaching the number of up to 10 (ten) units;
• d. statements from importers on the guarantee effective in Indonesia for quality and after sale service;
• e. other documents stipulated by the Director General as meant in paragraph (1).

Article 2

The import motor vehicles in CBU condition as contained in the attachment to this decree shall not be granted Type Registration Certificates (TPT) and their import shall be prohibited.

Article 3

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall announced by publishing it in the State Gazette of the Republic of Indonesia.
